Standard Terms and Conditions of Sale

1. Definitions

• “Company” refers to TSA Welding Supplies, a registered entity in South Africa.
• “Customer” refers to any person or entity purchasing goods or services from the Company.
• “Goods” means welding equipment, consumables, and accessories supplied by the Company.
• “Services” include technical advice, training, and support provided by the Company.


2. Application of Terms

• These Terms apply to all quotations, sales, and deliveries unless otherwise agreed in writing.
• Any conflicting terms proposed by the Customer are excluded unless expressly accepted.


3. Quotations and Orders

• Quotations are valid for 14 days unless otherwise stated.
• Orders are binding upon written acceptance by the Company.
• The Company reserves the right to refuse or cancel orders at its discretion.


4. Pricing and Payment

• All prices are in South African Rand and include VAT unless stated otherwise.
• Payment terms are strictly COD unless credit terms are approved in writing.
• Late payments may incur interest at 2% per month and suspension of further deliveries.


5. Delivery and Risk

• Delivery dates are estimates and not guaranteed.
• Risk passes to the Customer upon delivery or collection.
• The Company is not liable for delays caused by third parties or force majeure.

6. Returns and Refunds

6.1 Eligibility
Returns will only be accepted if:

• The goods are unused, unmarked, and in their original condition.
• Packaging is intact, undamaged, and includes all accessories, manuals, and labels.
• The return request is made within 7 calendar days of delivery or collection.


6.2 Exclusions
The following items are non-returnable unless proven defective:

• Custom-cut consumables or special-order items.
• Goods that have been installed, used, or altered in any way.
• Items without original packaging or proof of purchase.


6.3 Refunds

• Approved refunds will be processed within 7 business days of inspection.
• Refunds will be issued via the original payment method unless otherwise agreed.
• A handling or restocking fee may apply at the Company’s discretion.


6.4 Defective Goods

• Claims for defective goods must be reported within 48 hours of receipt.
• The Company will inspect and liaise with the manufacturer where applicable.
• Replacement or refund will be offered subject to manufacturer approval.


6.5 Return Procedure

• Customers must contact TSA Welding Supplies to obtain a Return Authorisation.
• Goods returned without prior approval may be refused or subject to delay.


7. Limitation of Liability

• The Company is not liable for indirect, consequential, or punitive damages.
• Technical advice is provided in good faith but without liability.
• Liability is limited to the value of the goods supplied.


8. Compliance and Safety

• Customers are responsible for ensuring goods are used in accordance with applicable laws and safety standards.
• The Company provides safety data sheets and educational materials upon request.


9. Intellectual Property

• All branding, content, and materials remain the property of TSA Welding Supplies.
• No reproduction or use is permitted without written consent.


10. Data Protection

• Personal information is processed in accordance with POPIA.
• The Company does not share customer data without consent, except as required by law.


11. Dispute Resolution

• Any disputes shall be governed by South African law and resolved in the jurisdiction of Gauteng.
• The Company encourages amicable resolution before legal proceedings.


12. General

• If any provision is found to be invalid, the remainder shall remain in full force.
• These Terms may be updated periodically; the latest version will apply to all transactions.
